New UAE National Tolerance Programme

A “National Tolerance Programme” was recently approved by the UAE Cabinet, chaired by Vice President and Prime Minister and Ruler of Dubai, Sheikh Mohammed bin Rashid Al Maktoum. Its aim is to promote values of peaceful coexistence between societies. The seven pillars of this Programme are Islam, the UAE constitution, the legacy of Sheikh Zayed bin Sultan Al Nahyan and the ethics of the UAE, international conventions, archaeology and history, humanity, and common values.

Under this new National Tolerance Programme, a number of initiatives will be launched including the establishment of a Council for Tolerance and as well as the launch of a Tolerance Responsibility Programme for Organizations and the UAE Charter of Tolerance, Coexistence and Peace.

Publishing pictures of women without their consent is an offence

The UAE Ministry of Interior has recently reasserted women’s right to privacy by stating that publishing pictures of women without their approval is an offence that can be sanctioned by a fine, or worse, by jail. The statement made by the Ministry of Interior was specifically aimed at people taking pictures at weddings and private parties and then publishing them on the internet. Not only is publishing the pictures an offence, but taking pictures and showing them to other people is also considered as an offence by UAE Ministry of Interior.

Indeed, this is considered as a violation of one’s right to privacy. Therefore, the acts of taking pictures, showing them to other people or publishing them require the approval of the person appearing on the picture.

Real Estate Brokers in Dubai are sanctioned from making unsolicited telephone calls to Property Owners

The practice of so-called “cold calling” is prohibited in Dubai. It is defined as the act of making an unsolicited visit or telephone call to someone in an attempt to sell goods or services.

Dubai Land Department (‘DLD’) has recently released the following statement: “Real Estate Regulatory Agency (‘RERA’), the regulatory arm of DLD, has fined four real estate brokers and stopped them from work for three months for the reason of not obeying the recent circular of not contacting and text messaging the property owners without a prior authorization from their side”.

According to a circular dated 11/08/2013 issued by the RERA, all real estate brokers are not allowed to text or call property owners if their properties are not listed by the owner for sale or rent as per used templates by the real estate offices. No sanction is expressly specified within the circular. However, according to DLD, real estate agents making “cold-calls” could face fines up to AED 50,000. Suspension from working is also a sanction which can be taken by DLD.

A New Law Seeks to Preserve Dubai’s Financial Stability

Highlight on the Dubai Economic Security Centre

In order to protect Dubai’s economy from financial risks and crimes, Law No (4) of 2016 on the Dubai Economic Security Centre was issued by His Highness Sheikh Mohammed bin Rashid Al Maktoum, Ruler of Dubai, Vice President and Prime Minister of the UAE.

The new Law has come into force upon its publication in the Official Gazette on May 15th, 2016.

The purpose behind the creation of the Dubai Economic Security Centre (DESC) is to minimize illegal and harmful activities within Dubai’s financial markets, protect investors from risks and predict and manage risks and negative economic practices which could threaten the stability of Dubai’s economy.

The DESC’s structure

The DESC shall comprise an executive authority including an Executive Director as well as administrative, financial and technical staff members. The Executive Director shall be appointed by the Chairman of the Dubai Executive Council.
